This bill clarifies the definition of "manufactured hemp product" in Hawaii state law to provide more flexibility for the Department of Health's rulemaking authority. Specifically, the bill modifies the existing definition to explicitly include: (1) products created by processing that are intended for oral consumption (such as tablets, capsules, powders, or hemp oil) or topical application; and (2) any other hemp-related products that the Department of Health may specify in its rules. The bill aims to address an ambiguity in a previous law (Act 263 from 2023) that might have unintentionally limited the department's ability to regulate new types of hemp products. The changes ensure that the definition remains broad enough to encompass current and future hemp-derived products, while continuing to exclude living hemp plants, viable seeds, leaf materials, and floral materials from the definition. The bill will take effect immediately upon approval.
