This concurrent resolution authorizes the Board of Land and Natural Resources to issue a 25-year, non-exclusive easement to Graham and Marisa Chelius for a shoreline protection structure located on state submerged lands near their property in Kikiaola, Kekaha, Kauai. The resolution stems from an emergency authorization initially granted in 2013 for temporary shoreline stabilization using geotextile bags, which was subsequently extended multiple times. After a review of the temporary permits, state land officials determined that a long-term easement would be more appropriate and compliant with Hawaii Revised Statutes. The easement covers 2,366.18 square feet and will allow the property owners to use, repair, and maintain the existing shoreline protection structure. As part of the process, the Cheliuses have executed a removal bond of $44,855 and will pay monthly rent and fair market value for the easement area, with the approval subject to authorization by the Governor and Legislature. The resolution requires that a certified copy be transmitted to the Chairperson of the Board of Land and Natural Resources.
