This concurrent resolution authorizes the Board of Land and Natural Resources to issue a 25-year, non-exclusive easement to Graham and Marisa Chelius for a shoreline protection structure located on state submerged lands near their property in Kikiaola, Kauai. The easement covers 2,366.18 square feet and is the result of a lengthy process involving emergency permits and temporary authorizations for erosion protection. Originally, the property owners were granted an emergency conservation district use permit in 2013 to place geotextile bags along their property's makai (seaward) boundary to stabilize the shoreline. After multiple permit extensions and a review by state land authorities that determined the previous permit practices were improper, the Board of Land and Natural Resources approved converting the temporary permits to a long-term easement. The resolution requires the Chelius family to pay fair market value for the easement, as determined by an independent appraisal, and they have already executed a removal bond of $44,855 to protect the state in case the easement is not approved. The resolution is being made pursuant to section 171-53 of Hawaii Revised Statutes, which requires legislative and gubernatorial approval for leasing state submerged lands.
