This concurrent resolution authorizes the Board of Land and Natural Resources to issue a perpetual, non-exclusive easement to the City and County of Honolulu for a portion of state submerged lands located at Maunalua, Honolulu, Oahu. The easement covers 1,050 square feet and is specifically for a stormwater management outfall and drainage system, allowing the city to use, repair, and maintain the improvements constructed on the site. The resolution stems from a February 9, 2018 Board of Land and Natural Resources approval, which granted permission to replace an outdated and ineffective drainage outfall. The easement will be granted at no cost (gratis consideration), in compliance with section 171-53(c) of the Hawaii Revised Statutes, which requires prior approval from the Governor and authorization from the Legislature through a concurrent resolution before leasing state submerged lands. The resolution also directs that a certified copy be transmitted to the Chairperson of the Board of Land and Natural Resources.
