This concurrent resolution authorizes the Board of Land and Natural Resources to grant a perpetual, non-exclusive easement to the City and County of Honolulu for a 1,050 square foot area of state submerged lands located near Maunalua, Honolulu, Oahu. The easement is specifically for a stormwater management outfall and drainage system, allowing the city to use, repair, and maintain the infrastructure on these lands. The resolution stems from a February 2018 Board of Land and Natural Resources decision that approved a Conservation District Use Permit for replacing an outdated and ineffective drainage outfall, and the easement will be granted at no cost (gratis consideration). The authorization is required under section 171-53(c) of the Hawaii Revised Statutes, which mandates that leasing state submerged lands must receive prior approval from the Governor and authorization from the Legislature through a concurrent resolution.
