This bill establishes the "New York native plants program" to protect and improve the state's natural environment by promoting the use of native plants and eco-friendly landscaping practices on public lands. Native plants are defined as species indigenous to New York that can adapt to climate change, or those from elsewhere in the U.S. likely to shift into New York due to climate change, including seeds and plant parts for propagation. The program, overseen by the commissioner of environmental conservation, will identify and list native plants suitable for different ecoregions (areas with similar ecosystems and environmental conditions) within the state, and may offer rebates to encourage their purchase. Plans for public spaces, referred to as "greenspaces" (public land for recreation, conservation, or aesthetics, excluding zoos and similar institutions), will require the use of native plants where practical, with considerations for site conditions, minimal maintenance, water usage, and benefits to local wildlife. The bill also mandates public education on the importance of native plants, the creation of demonstration projects, and encourages partnerships with various organizations to increase the availability and knowledge of native plants. Exceptions are made for situations where no native plant is suitable, for certain agricultural activities focused on food production, and for temporary non-native cover crops used to establish native plants. The bill takes effect immediately.
