This bill establishes new regulations for health-related research facilities in Colorado regarding the adoption of dogs and cats used in research. The bill defines key terms such as "animal," "health-related research," and "health-related research facility," and requires these facilities to offer dogs and cats for adoption through an animal shelter, pet animal rescue, or their own internal adoption program before euthanizing them. If a dog or cat must be euthanized for research, health, or safety reasons, the facility is exempt from this requirement. Research facilities must submit an annual report to the Colorado Department of Agriculture by January 31st, detailing the number of dogs and cats transferred or adopted out, while protecting the personal information of internal adopters. The bill provides civil liability immunity for facilities acting in good faith during the transfer or adoption process. Importantly, if any part of this legislation conflicts with the federal Animal Welfare Act, only the conflicting portion will be deemed inoperative. The act will take effect after the standard legislative review period, with a potential referendum vote in November 2026 if challenged.
