This bill amends the New York Public Health Law to establish specific per diem payment rates for hospitals designated by the federal Department of Health and Human Services as exempt extended neoplastic disease care hospitals (specialized hospitals focusing on cancer treatment). The bill mandates that rates for these hospitals will be calculated using their 2023 operating costs, adjusted for inflation and other factors determined by the health commissioner. Rates can be set on a per case or per diem basis and will cover both inpatient and outpatient services. The bill requires that base period reported operating costs be updated at least every three years and that hospitals submit additional data to help develop ambulatory patient group (APG) rates for their specialty services. Additionally, the bill ensures that when these hospitals provide services to Medicaid managed care patients, they will be paid at least the standard Medicaid fee-for-service rates for inpatient and outpatient services. The provisions will take effect on April 1, 2025, giving the health commissioner time to develop necessary rules and seek federal approvals.
