This bill prohibits the retail sale of flavored tobacco products and accessories in New York State by amending the public health law. The bill defines a "characterizing flavor" as any distinguishable taste or aroma other than tobacco, including flavors related to fruits, chocolate, candy, desserts, alcoholic beverages, mint, herbs, spices, or menthol. Any tobacco business licensed under article twenty of the tax law is prohibited from selling or offering for retail sale tobacco products with a characterizing flavor or accessories that could impart such a flavor. Violators will be subject to a civil fine of up to $500 for each infraction, and complaints can be submitted by any person to designated personnel. Importantly, the bill also includes a provision preventing law enforcement from stopping, questioning, searching, or arresting individuals based on possession, consumption, or purchase of flavored tobacco products. The law will take effect 90 days after becoming law, with immediate authorization for preparing necessary implementing regulations.
