This bill amends the New York cannabis law by creating a new private right of action for individuals who have been injured by certain violations related to cannabis licensure. Specifically, the bill allows any person who has been harmed by a violation of subdivision one of section one hundred twenty-five of the cannabis law to file a civil lawsuit seeking either an injunction to stop the unlawful act or monetary damages, or both. If the court finds that the defendant willfully or knowingly violated the law, it may increase the damages award up to three times the actual damages suffered. Additionally, the bill provides that a successful plaintiff can be awarded reasonable attorney's fees. This provision empowers individual citizens to take legal action against cannabis license holders who breach specific regulatory requirements, providing a mechanism for private enforcement of the law beyond government-initiated actions by the cannabis office or attorney general.
