AN ACT to amend the cannabis law, in relation to authorizing for a private right of action for certain violations

This bill amends the New York cannabis law by creating a new private right of action for individuals who have been injured by certain violations of cannabis licensure regulations. Specifically, the bill allows any person who has been harmed by a violation of subdivision one of section one hundred twenty-five of the cannabis law to file a civil lawsuit seeking either an injunction to stop the unlawful practice, monetary damages, or both. If the court determines that the defendant willfully or knowingly violated the law, it may increase the damage award up to three times the actual damages suffered.
