Bill Summary

As enacted, generally restricts a landlord from prohibiting a residential tenant from lawfully possessing, carrying, transporting, or storing a firearm, any part of a firearm, or firearm ammunition in the tenant's residential property; a vehicle located in a parking area provided for tenants or tenants' guests; or other locations controlled by the landlord necessary to enter or exit any such location in leases entered into, amended, extended, or renewed on or after July 1, 2026. - Amends TCA Title 66.

AI Summary

This bill, effective January 1, 2027, generally prevents landlords from prohibiting residential tenants from lawfully possessing, carrying, transporting, or storing firearms, firearm parts, or ammunition within their leased homes, in their vehicles in designated parking areas, or in other landlord-controlled areas necessary for entering or exiting these locations, with some exceptions for specific types of facilities like hospitals, nursing homes, and educational properties. Landlords can, however, require tenants to transport firearms concealed or holstered, or stored in a carrying container, when moving between their vehicle and residence or in common areas like elevators and hallways, and can take action if tenants fail to comply with these specific requirements, as long as it doesn't prohibit lawful possession within the tenant's residence. Tenants who believe their rights under this bill have been violated can sue their landlord for damages and legal fees.
