This bill, effective January 1, 2027, generally prevents landlords from prohibiting residential tenants from lawfully possessing, carrying, transporting, or storing firearms, firearm parts, or ammunition within their leased property, in their vehicles in designated parking areas, or in other landlord-controlled areas necessary for entering or exiting these locations. Landlords can, however, require tenants to transport firearms between their vehicle and residence, or keep them in common areas like elevators or hallways, only while the firearm is concealed, holstered, or stored within a carrying container. If a tenant fails to comply with these specific storage requirements, the landlord can request compliance or pursue other agreed-upon remedies, but cannot prohibit lawful possession within the tenant's residence. This law does not apply to certain facilities such as state-leased premises, mental health or children's services facilities, hospitals, nursing homes, assisted living facilities, or educational properties. Tenants who are negatively impacted by a landlord's violation of these provisions can sue for damages and legal fees, and landlords are protected from civil liability solely for complying with this act.
