Bill Summary
As enacted, generally restricts a landlord from prohibiting a residential tenant from lawfully possessing, carrying, transporting, or storing a firearm, any part of a firearm, or firearm ammunition in the tenant's residential property; a vehicle located in a parking area provided for tenants or tenants' guests; or other locations controlled by the landlord necessary to enter or exit any such location in leases entered into, amended, extended, or renewed on or after July 1, 2026. - Amends TCA Title 66.
AI Summary
This bill amends Tennessee law to prohibit landlords from restricting tenants' rights to possess, carry, transport, or store firearms and ammunition in their rented homes, apartments, businesses, or vehicles parked in areas provided by the landlord. The legislation applies to both residential and commercial leases and takes effect on July 1, 2025. Existing leases that contain provisions prohibiting firearms will have until July 1, 2026, to be amended to comply with the new law, with any conflicting lease terms becoming void and unenforceable. The bill provides tenants with a legal avenue to seek recourse if a landlord violates these provisions, allowing them to sue for actual damages, punitive damages, and attorney fees. By protecting tenants' Second Amendment rights in rental properties, the bill aims to prevent landlords from restricting lawful firearm possession and ensure that tenants can legally keep and transport firearms in their rented spaces and associated parking areas. The legislation applies broadly, covering not just the rented unit itself, but also vehicles and areas necessary for entering and exiting the premises.
