This bill amends title 38 of the United States Code to authorize veterans who have been awarded the Purple Heart for service in the Armed Forces after September 11, 2001, to transfer their unused Post-9/11 Educational Assistance benefits to eligible family members. The bill allows these Purple Heart recipients to transfer up to 36 months of educational benefits to dependents as defined by specific military dependent classifications, including spouses and children. Veterans can designate which dependents receive the benefits and how many months each receives, and they can modify or revoke the transfer at any time. The transferred benefits can be used by children only after completing high school or turning 18, and children have until age 26 to use the benefits, with some exceptions for primary caregivers of seriously injured service members or in emergency situations. The bill also specifies that transferred benefits cannot be considered marital property in divorce proceedings and that both the veteran and the dependent are jointly responsible for any overpayments. The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, will develop regulations to implement these provisions, ensuring that Purple Heart recipients can support their family members' educational opportunities.
