This bill amends the New York state finance law to create a preference system for New York state businesses in the state contract award process. Specifically, if a bid is submitted by a company with its headquarters and primary business presence in New York state, and that bid is within five percent of the winning bid, the New York state business will be given preferred status. To qualify as having a primary business presence in New York, a company must generate more than 50% of its combined gross revenues from business activity in the state and have more than 50% of its full-time equivalent employees working in New York. If multiple bids meet these criteria, the best preferred status bid will be considered the winning bid. The bill is designed to provide an economic advantage to local businesses by giving them a competitive edge in the state contract bidding process. The provisions of this bill will take effect one year after it becomes law, allowing businesses time to adjust to the new requirements.
