This bill amends the state finance law to provide a preference to New York state businesses in the state contract award process. Specifically, if a bid is submitted by a company headquartered and primarily doing business in New York state, and that bid is within five percent of the winning bid, the New York state business will be given preferred status. A company is considered to have a primary business presence in New York if it generates more than 50% of its gross revenues from business activity in the state and employs more than 50% of its full-time equivalent employees in New York. In cases where multiple bids receive preferred status, the bid with the best preferred status will be considered the winning bid. The bill is designed to give a competitive advantage to local businesses by allowing them to win state contracts even if their bid is slightly higher than the lowest bid. The provisions of this bill will take effect one year after it becomes law, providing businesses time to adjust to the new procurement rules.
