This bill introduces a new requirement for government entities holding easements over private property, mandating that they provide actual notice to property owners before using those easements. Specifically, local, state, or other government entities must now communicate directly with property owners through mail, email, or telephone prior to accessing their easement. If a municipality or state agency fails to provide this actual notice, they can be subject to a civil penalty of $500 for each violation. Additionally, property owners who are negatively impacted by a failure to provide proper notice are granted the right to file a lawsuit in district court to recover actual damages, the prescribed penalties, court costs, and reasonable attorney fees.
