This bill requires government entities (including local, state, or other government agencies) that hold easements over private property to provide "actual notice" to property owners before using those easements. Actual notice means the government must directly communicate with the property owner via mail, email, or telephone prior to accessing the easement. If a municipality or state agency fails to provide this direct notice, they can be penalized $500 for each violation. Additionally, property owners who are negatively impacted by a notice violation have the right to sue in district court to recover their actual damages, the prescribed penalties, court costs, and reasonable attorney fees. This law appears designed to enhance property owners' rights and ensure they are informed when government entities intend to use easements crossing their land, providing a mechanism for accountability and potential compensation if proper notification procedures are not followed.
