This bill modifies North Carolina's existing law regarding firearm possession by felons, creating new criminal offenses with escalating levels of severity based on how a firearm is used during the commission of another felony. Currently, it is unlawful for a person convicted of a felony to purchase, own, or possess a firearm. The bill introduces three new graduated offense levels: a Class F felony for possessing a firearm while committing another felony, a Class D felony for brandishing (displaying or making the presence of) a firearm during a felony, and a Class C felony for actually discharging a firearm during a felony. These new provisions apply specifically to felonies under the state's criminal statutes or drug laws. The law defines a firearm broadly, including any weapon that can expel a projectile by explosive action, and provides exceptions for antique firearms and certain pardoned individuals. The bill will become effective on December 1, 2025, and will apply to offenses committed on or after that date, with the aim of creating stricter penalties for felons who possess or use firearms during the commission of additional criminal acts.
