Bill Summary

This bill directs the Department of Environmental Protection (DEP) to develop and implement a voluntary commercial applicator deicer training and registration program and establish criteria for training commercial applicators in methods for snow and ice removal and deicer applications that are effective and protect water quality. The bill requires DEP to certify third party training providers and programs at community colleges, vocational schools, universities, or other educational institutions in the State qualified to provide the training specified by the department. The bill requires each commercial applicator to successfully complete training and pass an examination prior to registering with the DEP, and thereafter to update training and registration as required by the DEP. Furthermore, the bill: 1) requires registered commercial applicators to maintain certain records and annually file certain reports; 2) establishes certain limits on liability for commercial applicators; and 3) provides for suspension or revocation of a commercial applicator registration for a violation of any provision of the bill, or for making a false statement, representation, or certification in any documents or information required to be submitted to the department, or in any records required to be maintained under the bill. Finally, the bill authorizes the Commissioner of Environmental Protection to adopt rules and regulations necessary to implement the bill's requirements.

AI Summary

This bill establishes a voluntary training and registration program for commercial applicators of deicers (substances used to melt snow or ice) in New Jersey, administered by the Department of Environmental Protection (DEP). The program aims to protect water quality by reducing excessive deicer application, and requires commercial applicators (individuals who apply deicers for hire) to complete a certified training program and pass an examination before registering with the DEP. Registered commercial applicators must maintain detailed records of their services, including dates, methods, types and amounts of deicers used, and submit annual reports to the DEP. The bill provides liability protection for registered applicators who follow the training program's methods, with exceptions for reckless conduct or intentional harm. The DEP will certify third-party training providers at educational institutions, maintain public lists of certified providers and registered applicators, and can charge fees to cover program costs. The department may suspend or revoke a commercial applicator's registration for non-compliance or false reporting, with a specified hearing process to contest such actions. The program is designed to balance environmental protection with practical snow and ice removal needs, offering both training and a regulatory framework for commercial applicators.
