Bill Summary

This bill directs the Department of Environmental Protection (DEP) to develop and implement a voluntary commercial applicator deicer training and registration program and establish criteria for training commercial applicators in methods for snow and ice removal and deicer applications that are effective and protect water quality. The bill requires DEP to certify third party training providers and programs at community colleges, vocational schools, universities, or other educational institutions in the State qualified to provide the training specified by the department. The bill requires each commercial applicator to successfully complete training and pass an examination prior to registering with the DEP, and thereafter to update training and registration as required by the DEP. Furthermore, the bill: 1) requires registered commercial applicators to maintain certain records and annually file certain reports; 2) establishes certain limits on liability for commercial applicators; and 3) provides for suspension or revocation of a commercial applicator registration for a violation of any provision of the bill, or for making a false statement, representation, or certification in any documents or information required to be submitted to the department, or in any records required to be maintained under the bill. Finally, the bill authorizes the Commissioner of Environmental Protection to adopt rules and regulations necessary to implement the bill's requirements.

AI Summary

This bill establishes a voluntary training and registration program for commercial applicators of deicing substances in New Jersey, aimed at protecting water quality and reducing unnecessary contamination from snow and ice removal. The Department of Environmental Protection (DEP) will develop a program to train and certify commercial applicators (individuals who apply deicing substances for hire) through third-party training providers like community colleges and universities. To become registered, applicators must complete a training program, pass an examination, and meet ongoing requirements such as maintaining detailed records of their work and submitting annual reports. The bill provides liability protections for registered commercial applicators who follow the approved training methods, with exceptions for instances of reckless conduct or intentional misconduct. The DEP will maintain public lists of certified training providers and registered commercial applicators, and will have the authority to suspend or revoke registrations for violations or false statements. Commercial applicators will be required to keep records of their services for at least three years, including dates of service, methods used, types and amounts of deicers applied, and property details. The program is designed to reduce excessive deicer application and protect water resources while providing cost-effective training for snow and ice removal professionals.
