This bill modifies Texas transportation code provisions related to toll projects and their eventual transition to non-toll status. The legislation introduces a new requirement that toll projects must be maintained without tolls once all project acquisition and construction costs have been paid, and all related bonds and interest have either been fully paid or sufficient funds have been set aside in a trust for their payment. When a toll project reaches this point, it will be transferred to one of three potential management scenarios: (1) becoming part of the state highway system if the Legislative Budget Board determines the state has resources to maintain it, (2) becoming part of the county road system if the county requests and receives approval, or (3) remaining maintained by the current toll project entity if neither of the first two options occurs. The bill removes previous provisions allowing surplus revenue from one toll project to be used for another and requires toll project entities to publish detailed annual financial reports. Additionally, the Texas Department of Transportation is mandated to conduct a comprehensive study by September 1, 2026, identifying all toll roads in the state, their projected toll-free dates, and the potential maintenance costs of integrating these roads into the state highway system. The legislation will take effect immediately if it receives a two-thirds vote in the Texas legislature, or on September 1, 2025, if it does not.
