This bill establishes the "New York State Buy North American Act", which requires state departments, municipalities, public authorities, and certain affordable housing projects to prioritize awarding contracts for manufactured building products to bidders who produce those products primarily in North America (defined as the United States, Canada, and Mexico). Specifically, when soliciting contracts for building materials like plumbing fixtures, flooring, lumber, windows, doors, and facades, these entities must award the contract to the responsible bidder offering North American-made products if their offer is within 10% of the lowest price or best value offer. The bill also includes provisions to penalize companies that falsely label products as "Made in North America" or misrepresent the origin of their products. If a court or agency determines a person has intentionally mislabeled products, that person becomes ineligible for state contracts. To qualify as "North American-made", at least 75% of a product's total value must come from materials, labor, and manufacturing performed in North America. The act aims to encourage and support domestic manufacturing while maintaining flexibility through a price-competitive provision and ensuring compliance with international procurement agreements. The law will take effect 180 days after becoming law.
