This bill enacts the "New York State Buy North American Act", which requires state agencies, municipalities, public authorities, and covered affordable housing projects to prioritize awarding contracts for manufactured building materials (like plumbing fixtures, flooring, lumber, windows, doors, and facades) to bidders who produce these products primarily in North America (defined as the United States, Canada, and Mexico). Specifically, when soliciting contracts, these entities must award the contract to the responsible bidder offering North American-made products if their bid is within 10% of the lowest price or best value offer. The bill also includes provisions to penalize companies that falsely label products as "Made in North America" by making them ineligible for state contracts. A product is considered "North American-made" if at least 75% of its total value (including materials, components, hardware, and labor) is sourced from North America. The bill applies to state finance law, municipal law, public authorities law, and affordable housing projects, and will take effect 180 days after becoming law. The goal is to encourage and promote the purchase of North American-manufactured building materials for publicly funded projects.
