This bill modifies the special separation allowance options for both state and local law enforcement officers with at least 30 years of creditable service. The legislation provides two calculation methods for determining the annual special separation allowance: officers can either receive 0.85% of their most recent annual base compensation for each year of creditable service, or receive 0.85% of their base compensation at 30 years of service multiplied by 30. To be eligible, officers must have completed either 30 years of service or be 55 years old with at least 5 years of service, must be under 62 years old, and must have completed at least 5 continuous years of law enforcement service immediately preceding retirement. The bill allows officers who qualify under both calculation methods to make a one-time, irrevocable election of which method to use. The special separation allowance payments will cease upon the officer's death, when they reach 62 years of age, or when they are reemployed by a state or local government (with some limited exceptions for specific types of temporary work). The changes will apply to law enforcement officers retiring on or after July 1, 2025, and aim to provide more flexibility and options for long-serving law enforcement officers nearing retirement.
