This bill establishes new regulations for hemp-derived consumable products and kratom products in North Carolina, making it unlawful for any person to sell or deliver these products to individuals under the age of 21, and also prohibiting individuals under 21 from possessing them. A "hemp-derived consumable product" is defined as a finished hemp product intended for ingestion or inhalation that contains a specific concentration of hemp-derived cannabinoids, including delta-9 THC at not more than 0.3% on a dry weight basis, but excludes topical products and certain seeds. A "kratom product" is defined as any consumer item containing mitragynine or 7-hydroxymytragynine, or both, extracted from the kratom leaf, and this definition also includes "synthesized kratom products" which are created through chemical or biosynthetic means rather than traditional food preparation. Violating these provisions will result in a Class 2 misdemeanor, with escalating fines for repeat offenses, and the law will take effect on December 1, 2026.
