This bill modifies the existing law regarding student dismissals for young children, specifically for preschool, prekindergarten, and kindergarten through grade 3 students. The bill clarifies that children participating in various early childhood programs such as early childhood family education, school readiness, voluntary prekindergarten, Head Start, and other school-based preschool or prekindergarten programs are not subject to disciplinary dismissals. The legislation maintains an exception for short-term dismissals of less than one school day, particularly for students receiving special education services. Importantly, the bill stipulates that expulsions and exclusions can only be used as a last resort, after all other intervention resources have been exhausted, and solely in situations where there is a continuing serious safety threat to the child or other individuals. By making these modifications, the bill aims to protect young students from unnecessary removals from educational settings and ensure that disciplinary actions are used sparingly and only when absolutely necessary for safety reasons.
