This bill amends Tennessee state law regarding the payment of a deceased employee's wages or compensation to their surviving family members. Specifically, the bill removes previous restrictions on the amount of wages that can be directly paid to a deceased employee's surviving spouse or children. Under the new law, an employer can pay any owed wages directly to the surviving spouse or a trust for the spouse's benefit, or if no spouse exists, to the surviving children as tenants in common or a trust for their benefit. Additionally, if no personal representative has been appointed within six months of the employee's death, other entities can pay up to $10,000 directly to the surviving spouse or children, with any amount exceeding $10,000 requiring court direction or payment to a personal representative. The bill also specifies that these payments will be charged against the deceased's elective share, homestead allowance, and year's support allowance. If the recipient is a minor, the payment will be made to their guardian or custodian. The law takes effect immediately upon becoming law.
