This bill amends the New York Public Authorities Law to establish a structured, qualification-based selection process for hiring professional firms providing architectural, engineering, geological, landscape architectural, or surveying services. Under the new requirements, public authorities and public benefit corporations must first evaluate firms' qualifications by reviewing annual statements and performance data, then select at least three firms they deem most highly qualified for a specific project. The corporation must then negotiate a contract with the most qualified firm, focusing on fair and reasonable compensation based on the estimated value, scope, complexity, and professional nature of the services. If negotiations with the top-ranked firm fail, the corporation must progressively move to the second and third most qualified firms, continuing negotiations until an agreement is reached. The new provisions apply only to services exceeding $25,000 and do not cover certain transportation authorities. The goal is to ensure that public entities select professional service providers based on demonstrated competence and qualifications rather than solely on cost, promoting quality and expertise in important technical and design projects.
