Bill Summary

AN ACT REQUIRING NOTICE AND CONSENT BEFORE AN INSURANCE INSTITUTION OR AGENT MAY USE VEHICLE TELEMATICS.

AI Summary

This bill requires insurance companies and agents to obtain explicit written consent before collecting, using, selling, or sharing vehicle telematics data, which is defined as information about an individual's driving habits collected through tracking devices, applications, or software installed in a motor vehicle or mobile device. Specifically, insurance institutions must first notify applicants or policyholders about how the telematics data will be used, obtain their written consent, and inform them that they can revoke consent at any time. If a policyholder chooses to revoke consent, the insurance company must provide a reasonable method for doing so and must stop using the telematics data within 24 hours of receiving the revocation. The bill also amends existing law to clarify that insurance companies collecting such data are exempt from certain cyberstalking restrictions, provided they obtain proper consent. Violations of these requirements will be considered both an unfair trade practice and an unfair and deceptive trade practice, which could result in penalties. The law is set to take effect on October 1, 2025, and will apply to insurance contracts issued, renewed, or amended on or after that date.
