This bill amends Georgia law to prohibit condominium associations, property owners' associations, and homeowners' associations from preventing property owners from installing solar energy devices on roofs or roof structures, even if those roofs are considered common areas maintained by the association. A "solar energy device" is defined as equipment that uses solar radiation to generate energy for heating, cooling, or power generation, including related equipment for collecting, storing, and converting solar radiation. The bill mandates that associations cannot require permits or fees for solar device installation, with one key exception: if roof maintenance is needed after a solar device is installed on a common roof, the property owner who installed the device must pay for its removal and reinstallation. These provisions will apply to new agreements, renewals, modifications, and association rules created on or after January 1, 2026. The bill aims to promote solar energy adoption by removing potential barriers created by homeowners' associations and ensuring property owners have the right to install renewable energy equipment on their property.
