This bill modifies the existing Minnesota law related to advanced biofuel production incentives by updating eligibility requirements for facilities seeking state payments. The bill maintains the requirement that facilities must source at least 80% of their raw materials from Minnesota, with a special provision allowing facilities within 50 miles of the state border to source materials from within a 100-mile radius. Eligible raw materials include agricultural, forestry, or solid waste sources. To qualify, facilities must be located in Minnesota, begin production between April 1, 2023, and June 30, 2025, and produce at least 23,750 MMbtu (million metric British thermal units) of advanced biofuel quarterly. The bill explicitly excludes conventional corn ethanol and conventional biodiesel from eligibility and clarifies that payments will not be made for production occurring after June 30, 2035. Additionally, the bill specifies that producers cannot transfer their eligibility to a different facility location, will become ineligible for payments if they cease production, and cannot receive payments for the same production under other renewable energy programs. Notably, the bill confirms that biobutanol remains eligible for these incentive payments.
