This bill modifies Minnesota's advanced biofuel production incentive program by making several key changes to the existing law. The bill maintains the requirement that eligible biofuel facilities must source at least 80 percent of their raw materials from Minnesota, with a special provision allowing facilities within 50 miles of the state border to source materials from within a 100-mile radius. The facility must be located in Minnesota, begin production between April 1, 2023, and June 30, 2025, and produce at least 23,750 MMbtu (million British thermal units) of advanced biofuel quarterly. The bill explicitly excludes conventional corn ethanol and conventional biodiesel from eligibility, but includes existing companies expanding their capacity, new facilities, and specifically mentions biobutanol as an eligible advanced biofuel. Payments will not be made for production after June 30, 2035, and producers cannot transfer their eligibility to a different location. Additionally, producers who cease production will become ineligible for payments until they resume production, and the bill ensures that facilities receiving payments for renewable chemical or biomass thermal production cannot also receive payments under this advanced biofuel incentive program.
