This bill amends the mental hygiene law to expand the duties and structure of the independent developmental disability ombudsperson program, which helps individuals with developmental disabilities access services and protect their rights. The program will now be based in New York state and must include a toll-free hotline, an interactive website, and accessible staff or volunteers via in-person, phone, or email. Its responsibilities will include assisting individuals in navigating and completing processes, filing and preparing appeals, resolving problems encountered, and educating individuals about their rights and responsibilities regarding services provided by the state office for people with developmental disabilities, care coordination organizations, and other certified providers. The bill also mandates that notices and materials from these entities include the ombudsperson program's contact information and requires the program to submit an annual report with recommendations to state officials and post it online. Importantly, the program will be established through a competitive bidding process, excluding entities that currently receive funding for services or bill Medicaid, and prioritizing applicants with experience in advocacy, call center operations, or confidential case tracking.
