Bill Summary

This bill relates to testimony by certain witnesses by two-way closed-circuit equipment. The bill provides that upon its own motion or upon motion of any party, a court may protect a minor up to 18 years of age from trauma caused by testifying in the physical presence of the defendant where it would impair the minor’s ability to communicate, by ordering that the testimony of the minor be taken in a room other than the courtroom and be televised by two-way closed-circuit equipment for viewing in the courtroom. Current law does not specify that the closed-circuit equipment be two-way. Upon a finding of necessity, the court may also allow the testimony of a victim or witness with a mental illness, an intellectual disability, or other developmental disability to be taken by two-way closed-circuit equipment regardless of the age of the victim or witness.

AI Summary

This bill amends Iowa's existing law regarding testimony by vulnerable witnesses, specifically expanding the use of two-way closed-circuit television equipment during court proceedings. The bill allows courts to protect minors under 18 years old from potential trauma by permitting them to testify in a separate room while their testimony is televised into the courtroom, ensuring the defendant can still see the witness. The key change is explicitly requiring two-way closed-circuit equipment, which means the witness can also see the defendant during testimony. Additionally, the bill provides that courts may also allow witnesses with mental illnesses, intellectual disabilities, or developmental disabilities to testify via two-way closed-circuit equipment if the court determines it is necessary. The goal is to create a less intimidating testimony environment for vulnerable witnesses while still preserving the defendant's ability to observe the witness's demeanor and testimony. This approach aims to balance the need to protect witnesses from additional psychological stress with maintaining the fundamental fairness of legal proceedings.
