This bill modifies Minnesota statutes to allow school districts an alternative method for renewing capital projects referendum levies without requiring a public vote. Specifically, a school board can now renew an expiring capital projects referendum by board action under certain conditions: the annual referendum amount must remain the same, the term cannot exceed the initial voter-approved term, the board must adopt a written resolution after a public meeting with testimony, and the referendum cannot have been previously renewed by board action. The board must take this action by June 15 of the year the new levy will be certified, and the resolution becomes effective 60 days after adoption. The school district must submit the adopted resolution to the commissioner and county auditor by September 1. This change provides school districts more flexibility in maintaining their capital project funding by potentially avoiding the cost and administrative burden of holding a public referendum, while still requiring public input through a board meeting and recorded vote. The bill takes effect immediately after final enactment.
