This bill modifies Minnesota school district laws to provide an alternative method for renewing capital projects referendum levies. Currently, school districts must hold a public election to renew a capital projects referendum, but this bill allows school boards to renew an expiring referendum by board action under specific conditions. These conditions include: maintaining the same annual referendum amount, keeping the renewal term no longer than the original voter-approved term, adopting a written resolution after a public meeting with testimony, and ensuring the referendum has not been previously renewed by board action. The board must adopt the renewal resolution by June 15 of the year the new levy will be certified, and can do so up to two fiscal years before the current referendum expires. The board must submit the resolution to the commissioner and county auditor by September 1, and the resolution becomes effective 60 days after adoption. This change provides school districts with more flexibility in managing their capital project funding while still maintaining transparency through public meetings and resolution requirements. The bill becomes effective immediately after final enactment.
