Bill Summary

An Act to Require Minimum Pay for Reporting to Work

AI Summary

This bill requires employers with at least 10 employees to provide minimum compensation to workers who are called in to work but then have their shifts canceled or reduced. Specifically, if an employee reports to work at an employer's request and then has their scheduled shift canceled or reduced, the employer must pay the employee either two hours of pay at their regular hourly rate or the total pay for the originally scheduled shift, whichever is less. The bill does not apply to seasonal workers, public employees covered by collective bargaining agreements, or situations involving adverse weather, natural disasters, employee illness, or workplace injuries. Employers can avoid paying these wages if they make a documented good faith effort to notify the employee not to report to work. If an employer cannot assign work to the employee upon arrival, they must still provide the minimum compensation. The Maine Department of Labor is authorized to create rules to implement and enforce this new provision, which would be classified as routine technical rules. The bill also amends an existing labor law to include this new section in the list of provisions subject to potential fines for violation.
