This bill expands the definition of child care providers authorized to conduct background clearances to include temporary child care employment agencies and child care educational and training institutions. Specifically, the bill amends existing social services law to add these new types of entities to the list of providers who can perform background checks on staff who may have regular contact with children. For temporary child care employment agencies (which supply substitute staff) and educational institutions (which assign interns or residents), they will now be subject to criminal history record check requirements for child care staff they place in day care centers or school-age child care programs. The bill requires these agencies to submit fingerprint cards and other information to the Office of Children and Family Services, which can deny or hold an employee's application. The office may charge a processing fee, and if they advise that an individual has no criminal history, no additional background check will be required when that individual is placed at a child care center. The changes are set to take effect on January 1, 2026, providing time for agencies to prepare for the new requirements.
