This bill amends the New York Social Services Law to expand background check requirements for child care providers by including temporary child care employment agencies and child care educational and training institutions. Specifically, the bill adds these two new types of entities to the list of authorized providers who can conduct background clearances, and requires them to submit fingerprint cards and other information to the Office of Children and Family Services (OCFS) for criminal history record checks for child care staff who may be placed at child day care centers or school age child care programs. The bill defines a "temporary child care employment agency" as an entity that supplies substitute child care staff on a temporary basis, and a "child care educational and training institution" as an entity that assigns child care staff as interns or residents. Under the new provisions, when OCFS confirms that an individual has no criminal history, no additional background check will be required when that individual is placed at a child care center. The OCFS may charge these agencies a processing fee for conducting the background checks, and the bill provides the agency with the authority to deny or hold an employee's application in certain circumstances. The changes are set to take effect on January 1, 2026, giving providers time to prepare for the new requirements.
