This bill requires all new washing machines sold in New York State after January 1, 2030, to include a microfiber filtration system that can remove at least 90% of fibers and microfibers that are 100 micrometers or larger. The bill defines a microfiber filtration system as a filter or series of filters built into or packaged with the washing machine to capture these tiny particles from the water during washing cycles. Manufacturers must provide a certificate of compliance to distributors and retailers, stating that their washing machines meet these requirements. Additionally, each washing machine with a filtration system must have a visible sticker informing consumers about the microfiber capture feature and providing instructions on how to maintain and check the filter. Distributors and retailers can sell existing non-compliant washing machine inventory acquired before December 31, 2029. The Department of Environmental Conservation is authorized to create implementation rules, and violations can result in civil penalties ranging from $500 for the first offense to $1,000 for subsequent offenses, which can be enforced by various legal authorities such as the attorney general or district attorneys.
