This bill amends Michigan's existing law regarding embezzlement from vulnerable adults by expanding the scope of prosecution to include actions taken both during a vulnerable adult's lifetime and after their death. The bill establishes a graduated penalty system based on the value of money or property obtained fraudulently, ranging from misdemeanors for amounts less than $200 to felonies for amounts over $100,000, with increasingly severe punishments for repeat offenders. The bill introduces a new provision that allows prosecutors to aggregate the value of money or property obtained from a single vulnerable adult across different incidents within a 12-month period, and importantly, allows aggregation of values obtained both during the vulnerable adult's life and after their death. The legislation also clarifies that financial institutions and their employees are not in violation of the law when performing normal business duties. Additionally, the bill mandates that the Office of Services to Aging report any violations to the Department of Health and Human Services, emphasizing protections for vulnerable adults who may be unable to defend themselves against financial exploitation. The bill will take effect 90 days after being enacted into law.
