This bill mandates that certain State-funded construction projects, meaning those supported partially or entirely by state funds, must use plastic construction materials that contain a specific percentage of "postconsumer recycled content," which refers to materials that have already been used and recycled. Starting one year after the bill becomes law, plastic construction materials used in these projects must contain at least 10% postconsumer recycled content for the first two years, and then increase to 15% thereafter. However, these requirements do not apply if using such materials would increase the overall cost of the project by 20% or more, if suitable recycled plastic materials are unavailable in sufficient quantities or within 60 days of the project's start, if a licensed architect or engineer certifies that using them would negatively impact structural integrity and safety, or if the construction is for low-income or moderate-income housing. The Commissioner of Environmental Protection will be responsible for creating the necessary rules and regulations to implement this act.
