This bill requires that certain State-funded construction projects, meaning projects supported by State funds and carried out by government entities like state agencies or local governments, must use plastic construction materials that contain a specific amount of "postconsumer recycled content," which refers to materials that have been used and then recycled. Specifically, starting one year after the law takes effect, plastic construction materials must contain at least 10% postconsumer recycled content for the first two years, and then at least 15% thereafter. However, these requirements do not apply if using such materials would increase the overall project cost by more than 20%, if suitable plastic materials are unavailable or cannot be delivered within 60 days of construction start, if a licensed architect or engineer certifies that using these materials would negatively impact structural integrity and safety, or if the construction is for low-income or moderate-income housing. The Commissioner of Environmental Protection will be responsible for creating the necessary rules to implement this act, which takes effect immediately.
