This bill establishes a wastewater infrastructure and drinking water program starting April 1, 2026, designed to provide financial assistance for replacing and rehabilitating local municipal water systems. The program will offer grants to municipalities to help fund initial planning activities for Clean Water State Revolving Fund (CWSRF) water quality projects, specifically focusing on engineering reports, planning activities, and environmental reviews. Eligible systems include drinking water, storm water, and sanitary sewer systems owned by counties, cities, towns, villages, or public authorities, but excluding privately managed systems. Priority will be given to planning activities that address specific water quality needs, such as projects required by legal consent orders, State Pollutant Discharge Elimination System (SPDES) permits, wastewater system upgrades, addressing failing septic systems, or targeting specific pollutants identified in watershed implementation plans like Total Maximum Daily Load (TMDL) or Harmful Algal Blooms (HABs) Action Plans. The commissioner of environmental conservation, in collaboration with the environmental facilities corporation, will develop regulations to ensure equitable distribution of aid, with the explicit understanding that design and construction costs are not eligible for funding under this program.
