This bill expands insurance coverage for in vitro fertilization (IVF) by modifying existing insurance law to provide more comprehensive fertility treatment coverage. Specifically, the bill requires large group health insurance policies to cover three complete oocyte retrievals (egg collection procedures) and allow unlimited embryo transfers from fresh or frozen eggs or embryos retrieved during those covered procedures. The bill also broadens the definition of infertility, defining it as the inability to establish a clinical pregnancy after 12 months of unprotected sexual intercourse (or 6 months for women over 35), and mandates coverage for various diagnostic tests and procedures related to infertility. Additionally, the bill prevents insurers from discriminating based on personal characteristics like age, sex, sexual orientation, or gender identity, and requires coverage for fertility preservation services when medical treatments might cause iatrogenic (treatment-induced) infertility. The changes will apply to policies issued, renewed, or modified on or after January 1, 2026, and aim to provide more accessible and comprehensive fertility treatment options for individuals and couples struggling to conceive.
