This bill expands the list of individuals who are ineligible for earned incentive release credits under the Minnesota Rehabilitation and Reinvestment Act. Specifically, the bill adds several new categories of offenders who cannot receive these credits, including those convicted of: crimes resulting in a person's death, first or second-degree criminal sexual conduct, criminal sexual conduct involving victims under 16 years old, child pornography or child exploitation offenses, violent crimes involving a dangerous weapon (as defined in section 624.712), and crimes that carried a mandatory minimum sentence. These changes are being made to sections 244.45 and 244.46 of Minnesota Statutes, which previously had a more limited set of exclusions for earned incentive release credits. The new restrictions will apply to individuals serving sentences for these specified serious and violent offenses, effectively limiting their ability to reduce their time in custody through earned credits. The bill becomes effective the day after it is finally enacted, meaning the new restrictions will apply to current and future inmates convicted of the specified offenses.
