This bill expands the list of individuals ineligible for earned incentive release credit and similar rehabilitation programs under Minnesota law. Specifically, the bill adds several new categories of offenders who cannot receive these credits, including those convicted of: crimes resulting in a person's death, first or second-degree criminal sexual conduct, criminal sexual conduct involving a victim under 16 years old, child pornography or child exploitation offenses, violent crimes involving a dangerous weapon (as defined in section 624.712), and any crime that carried a mandatory minimum sentence. These additions are made to sections 244.45 and 244.46 of Minnesota Statutes, which previously had a more limited set of exceptions for earned incentive release credits. The existing exceptions remain in place, such as those serving life sentences or indeterminate sentences for crimes committed before April 30, 1980. The bill will take effect the day after its final enactment, meaning these new restrictions on earned incentive release credits will apply to eligible offenders immediately after the bill becomes law.
