Bill Summary
AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend Title 25 of the District of Columbia Official Code to allow a retailer with commercial street frontage at a location under the jurisdiction of the Washington Convention and Sports Authority to be licensed for a streatery, require that alcohol businesses obtain a streatery endorsement from the Alcoholic Beverage and Cannabis Board to operate a streatery, expand existing carry out and delivery license requirements to retailers with commercial street frontage at a location under the jurisdiction of the Washington Convention and Sports Authority, require streatery, summer garden, and sidewalk café endorsement and streatery license applications to undergo a 45-day public comment period, and expressly require notice and an opportunity to protest applications for streatery, summer garden, and sidewalk café endorsements and licenses.
AI Summary
This bill amends District of Columbia alcohol licensing laws to create a formal regulatory framework for "streateries" - outdoor dining areas in parking lanes or designated street areas. Specifically, the bill requires businesses operating streateries to obtain a new streatery endorsement or license from the Alcoholic Beverage and Cannabis Board starting January 1, 2026. Businesses must pay a $100 annual fee, demonstrate their streatery is in a commercial or mixed-use zone, and maintain a distinctly separate dining area. The bill also extends existing temporary outdoor dining permissions through December 31, 2025, and requires a 45-day public comment period for streatery, summer garden, and sidewalk café applications. Notably, the legislation includes special provisions for businesses located under the Washington Convention and Sports Authority's jurisdiction, mandating they obtain specific licenses to continue selling alcohol in outdoor spaces. The bill aims to formalize and regulate the pandemic-era practice of expanded outdoor dining, ensuring businesses have a clear path to continued outdoor service while maintaining regulatory oversight and community input.
