Bill Summary

AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on an emergency basis, the Legalization of Marijuana for Medical Treatment Initiative of 1999 to amend the definition of an unlicensed establishment to include establishments that sell Schedule I substances or products that contain Schedule I substances, to authorize enforcement actions to be taken against all unlicensed establishments beginning on April 1, 2025, regardless of whether the unlicensed establishments have an application pending before the Alcoholic Beverage and Control Board , to authorize certain enforcement actions before April 1, 2025, against an unlicensed establishment that has an application pending before the Alcoholic Beverage and Control Board if the unlicensed establishment sells a Schedule I substance or a product that contains a Schedule I substance, to authorize summary closures and related enforcement actions to continue for as long as the imminent danger to the public persists and is likely to recur, and to allow the Alcoholic Beverage and Cannabis Administration and Metropolitan Police Department to take related enforcement actions against a licensed medical cannabis establishment that engages in certain unlawful activity.

AI Summary

This bill amends the District of Columbia's medical marijuana laws to expand enforcement actions against unlicensed establishments, particularly those selling Schedule I substances (controlled substances listed in the DC Uniform Controlled Substances Act). The bill broadens the definition of an "unlicensed establishment" to include businesses selling Schedule I substances, and authorizes the Alcoholic Beverage and Cannabis Administration (ABCA) and Metropolitan Police Department (MPD) to take enforcement actions against such establishments starting April 1, 2025. Key provisions include allowing summary closures and padlocking of establishments that pose an imminent danger to public health, with the ability to continue these actions even after the initial threat is addressed if there's a likelihood of recurrence. The bill also empowers ABCA investigators to test substances at licensed and unlicensed establishments for THC content and the presence of Schedule I substances. The emergency act will remain in effect for up to 90 days, providing a temporary but immediate mechanism to address concerns about unlicensed cannabis and controlled substance sales in the District of Columbia.
